Dear ECASBA Members,

Please find attached a FONASBA-ECASBA Members' Briefing on the EU Digital Waste Shipment System (DIWASS) and the implications of Regulation (EU) 2024/1157 for shipbrokers and port agents.

The briefing provides an overview of the new regulatory framework governing waste shipments within and from the European Union, with particular emphasis on:

•The mandatory implementation of the DIWASS digital platform and the associated compliance timeline;

•The classification and handling requirements for waste and scrap cargoes, including green-listed and hazardous waste;

•New documentation and pre-notification obligations;

•Enhanced enforcement measures and the expanded role of EU authorities;

•The operational, contractual and financial risks for shipbrokers and port agents, including potential liability as the "person arranging the shipment"; and

•Practical recommendations to help members prepare for and comply with the new requirements.

We trust that this briefing will assist members in understanding the significant operational changes introduced by the new legislation and in reviewing their internal procedures accordingly.
