TARIFF FOR WHARFAGE SERVICES: (Occupation  –  Unlawful Occupation)

 

    A-  Tariff of Türkiye Denizcilik Isletmeleri A.S forIstanbul Sarayburnu and Kurucesme:

 

Scope of Tariff:

This tariff includes harboring fees of the vessels docks, stern docks or mooring to Wharfs, Piers and Jetties of the Institution or anchorage in pier, or berth into the Wharfs or Piers of others within the pier.

Definition of Services:

                a) Occupation:Means harboring of vessels in locations determined under the scope of tariff during service period,

                b) Unlawful Occupation:Means unnecessary occupation of locations specified in Tariff by vessels either after completion of services or without permit of the Establishment.

 

a) Principals related to Occupation Services:

Fees includes the costs in consideration of service of occupation provided for vessel until completion of their works in wharf docks, piers or jetties of the Establishment or others.

Fees are collected per day/GT and proportions for their stay in specified boarding locations in the scope.

 

The day during which vessel is anchored or moored are day of leave are considered as full day.

 

b) Principles related to Unlawful Occupation:

 

The vessels which failed to leave harboring locations specified within the scope:

Although they have completed their works or in spite of notification to them to arrive to the locations allocated for them by the Establishment or notified to change their place and although departure bill issued to them by Port Authority, if they do not leave within 1 hour following issue of bill (however, by means of receiving written confirmation from shipping agency before departure time of vessel by the representatives of Company, if there is no other vessel for which Port Authority allocated place in the same wharf) harboring services are considered as occupation.

 

Their occupation without permission of Establishment,

 

Failure to request post although they have occupied such location (however, in case of unlawful occupation an assessment resulting from shift works, unlawful occupation fee is not charged when shift works are not carried by the Company)

 

It includes the fees to be charged per hour and fractions in case of failure of vessels performing loading-unloading operations with mechanical vehicles and equipment of work owner to start to work within two hours following their berthing to wharfs and piers. 1750 TL per day perday and units are charged

 

If departure permit is not given to vessel due to heavy weather conditions, no unlawful occupation fee is charged.

 

No occupation or unlawful occupation fee is charged to Turkish flag School and warships and, provided not to accept passengers or cargo, to marine vehicles used for public services in case of their harboring in the locations allocated for them.

 

Only harboring fee is charged to vessels which docks, stern docks to wharfs and piers of others until they leave such areas.

B- Tariff for Haydarpasa and Izmir Ports of TCDD Port Authority:

 

Scope of Tariff

This tariff includes harboring services of vessels and lash ships which docks, stern docks to the wharfs and piers, roping the vessels to buoy or breakwaters or anchoring within or approaching to wharfs and piers of others within berths, or roping to buoys or others within berths of the Authority.

 

Definition of Services

                a)Occupation: Means harboring of vessels or lash ships in the locations specified in the scope as long as services continue; in case of availability of wharfs, harboring of vessels approaching for the purpose of harboring without any loading/unloading operations to/from the port,

 

                b) Unlawful Occupation: Means unessential occupation of locations specified in the scope by the vessels or lash ships after completion of services or without permission of the Authority.

 

Principals of Occupation Services:

Fees includes the charges to be collected for harboring services of vessels or lash ships in wharfs, piers, breakwaters or buoys of the Authority or of others within the berth until completion of their works.

 

Fees are charged per day of stay of vessels and lash ships in the locations specified in the scope for each 1000GT and fractions.

 

The day of anchorage or roping of vessel or lash ship and day of departure from such locations are considered as full day.

 

If location of vessel or lash ship is shifted, higher harboring fee is applied for entire harboring period.

 

In case of any request to use marine vehicles in order to facilitate the services to be provided or due to insufficiency of depth of water in wharf or for another reason and if such request is accepted by the Authority, harboring fee is applied with 100% addition (In such a case, no fee is charged for marine vehicle)

 

Fees are charged to any other vessel approaching to the board of a vessel or lash ship harbored in harboring locations in consideration of harboring location of the vessel or lash ship approached.

 

Fixed and floating facilities of permanent nature constructed for the purpose of harboring are considered as harboring locations.

 

Principles of Unlawful Occupation

Fees include the charges to be collected per hour and fractions when vessels or lash ships in following cases;

 

Occupying harboring locations specified in the scope without permit of Establishment, failure to leave within 3 hours although they have completed their works or they have notified to shift to the locations allocated for them or notified to shift their location ,

Failing to request post although they have occupied (However, unlawful occupation fee for unlawful harboring resulting from shifting operations is not charged for periods during which shift studies are not carried by the Establishment)

 

In case of request of fresh water or bunker fuel by captain or agency of the vessel within 3 hours period granted after completion of works of the vessel, exceeding of such time period,

 

The vessels performing loading/unloading operations with mechanical vehicles and facilities of their owners stay of vessels after the end of 4 hours period granted for the preparation of such vehicles and facilities before starting to work.

 

If permit of departure is not granted to vessel by Port Authority or Company due to weather conditions, no unlawful occupation fee is charged.

 

In case of failure to provide services timely according to the service request due to lack of possibilities of Company to the vessels which must obtain pilot and tug boat, no unlawful occupation fee is charged for the waiting periods of vessel.

 

No occupation or unlawful occupation fee is charged to Turkish flagged,school and warships and, provided not to accept passengers or cargo, to marine vehicles used for public services in case of their harboring in the locations allocated for them.

 

Only harboring (occupation) fee is charged to vessels which docks, stern docks to wharfs and piers of others within berthing areas until they leave such areas.

 

Occupation Fees of Lash Ships

For each day and fractions of stay in the locations within the scope of lash ships launched to sea from main vessel:

For the detemination of type of vessels mentioned in tables  1 and 2, concerning the ships identified as used for mülti purposes  in clas certificates, to define ship type in order to settle application basis, weighted ship load is used as basis.

 

Definitions:

Pilotage Service: The service given to Ships by pilots and service boats

Towage Service:Being available alongside the vessel in the port and towing/pushing of the vessel if needed.

General Principles of Pilotage and Towage Services:

Basic fee for each service is indicated on the basic fee tables of this tariff. Tables demonstrating the tarif provisions and basic fees from an integrity in the implementation of this tariff. Add – on or discounted fees are applied on basic fees and, add – on and discounts don’t change the basic fee calculations to be made on tariff.

 

If there is more than one discount for one service, only the highest discount rate is applicable. If there is more than one discount for one service which are at the same rate, only one discount is applied.

 

However, if there is one add – on fee and one discount available for one service, the difference of these values (+,-) is applied to the basic fee.

 

In case services are given on the days specified in the 2429 numbered Law Related to National Feasts and General Holidays, fees are collected with an additional amount of 50 % of the basic fee exculuding holiday practice appliced as of 13:00 in Saturday at port services.

 

1.5.2 Services Provided to Ships Carrying Dangerous Goods/Goods


 1) In the services to be provided in the Turkish Straits;


a) TBDTDY article: The basic fees of tankers carrying the cargoes defined in paragraph 2 (s) are charged with an additional 30%,


b) The basic fees of ships carrying IMDG code class 1 and 7 cargoes are charged with an additional 30%,


c) TBDTDY article: The basic fees of ships other than tankers carrying the cargoes defined in paragraph 2 (s) (excluding IMDG codes 1 and 7) are charged with an additional 20%,


2) In the services to be provided at the ports;


a) The basic fees of tankers carrying dangerous goods in IMDG code class are charged with an additional 30%,


b) On ships other than tankers, the basic fees for ships carrying IMDG code class 1 and cargoes are charged as 30%, and for ships carrying other IMDG code class cargoes, the basic fees are charged with an additional 30%,


c) The basic fees of other vessels (except IMDG codes 1 and 7) other than tankers carrying the cargoes defined in paragraph (i) of the directive on the fees of pilotage, tugboat and mooring services are collected with an additional 20%.


3) The basic fees of the services to be provided to the tankers loaded with dangerous goods or not purified from dangerous goods, which make limbo to the warehouse ships deployed to store fuel in the open sea, are charged with an additional 50%.

 

Dangerous cargo addition is not taken from tanker class vessels and vessels that declare that they have a "Gasfree Certificate" indicating that the cargoes of other vessels other than tankers are not in the dangerous class and/or empty tankers designed to carry dangerous goods are taken within 24 hours before the start of service and that they are free of dangerous gases.

 

If the vessel has a Gasfree Certificate issued within 24 hours before start of the service, the basic fees in the tariff are applicable.

 

In Istanbul Port: Basic fees in table T.1 are applicable for pilotage service given in the Golden Horn and buoy and anchoring areas in Kadiköy, Salipazari, Haydarpasa, Sarayburnu and Dolmabahçe, while basic fees in table T.2 are applicable for towage services. For other piers, berths and facilities  (excluding Zeyport ) within the boundaries of Istanbul Port, the basic fee is applied with an additional amount of 100 % of the original fee.

 

In Other Ports: for pilotage services given in Inner and Intermadiate Ports, the basic fees specified in table T.1 are applicable while for towage services, fee in table T.2 are applicable. In ourter harbors of these ports, the fees for services are applied with an additional amount of 100 % of the basic fee.

 

Obligation to Take Pilot and Tug:

The obligation to take pilot / tug and exemption rates are determined by port regulation and directives.

 

Any fee shall be collected even pilotage and mooring rope services are rendered to Turkish flagged

School, War and Public Institution Search Vessels.

1. Tugboat waiting fee is half of the basic fee. It is essential that sea vehicles are not rented for purposes other than their intended purpose. However, in cases of force majeure and essential need, if the vehicle is rented by mutual agreement, the rental fees in table T.3 are applied. 

 2. Special purpose rental requests for the ERV NENE HATUN Emergency Response Ship; It is evaluated separately apart from the tariff.

 

Attandance fee:In case of suspention of the services not caused by the Organization and in the event that the service is done tardily:

                a) Base pay of pilot services and also attandance fee (waiting time charges) shall be collected

                b) Base pay for tug services and attandance fee (waiting time charges) according to T.3 table shall be collected.

 

In case of suspention of the services and in the event that they can not be rendered after waiting time:

                a) %50 of base pay for pilotage service and full attandance fee shall be collected

                b)%50 of base fee of the tug services defined in the table and besides attandance fee in T.3 table shall be collected.

 

Attandance fee is not collected forthe waiting up to one hour. Attandance feefor the total waiting time is collected for the waiting exceeding one hour. The Organization is both authorized to keep waiting or not its pilotage and tug vehicles and personnel rendering the services, and to perform other service demands within the waiting period.

 

If the services which has already started can not be rendered because of the force majeure (such as advarse weather condition), only 50% of the basic fee schedule is collected.
